Beth Kase  Partner

Beth Kase is a partner at Fenton Law Group and chairs the firm’s regulatory and transactional practices.  In addition, Beth has formed numerous physician group practices and advised on shareholder and partnership matters.

She is an experienced business and regulatory healthcare attorney and has represented a wide range of providers (including ASCs, hospitals, community clinics and affiliated mobile clinics, dialysis centers, skilled nursing facilities, hospices and laboratories) on numerous legal and operational matters.

Representative Experience

  • Structured and documented outpatient surgery center joint venture deal in Southern California, including management services agreement, physician investments, and Medicare provider agreement.
  • Negotiated a favorable settlement on behalf of a physician group in a dispute with hospital landlord alleging underpayment of rent and involving hospital self-report to the Centers for Medicare and Medicaid Services.
  • Represented the owners of five dialysis centers in sales transaction to a large nation-wide dialysis center operator.
  • Successfully negotiated a favorable settlement for a physician in a dispute with large medical group relating to employment termination and buy-out of physician’s ownership interest.
  • Structured and documented a medical partnership consisting of multiple professional medical corporation partners.
  • Represented outpatient surgery center in a dispute with a surgeon alleging breach of an exclusive contract and deceptive marketing practices.
  • Obtained tax payer exemption, licensure and Medicare and Medi-Cal provider enrollment for a new hospital located within campus of another licensed hospital facility in Orange County.
