Henry Fenton successfully defended a prominent interventional cardiologist against claims of unprofessional conduct, gross negligence, repeated acts of negligence and failure to maintain adequate records based upon treatment and interventions provided to five patients. Mr. Fenton argued and presented convincing evidence that the cardiologist’s clinical judgments were reasonable and that all of his coronary interventions were consistent with necessary emergency protocols. The Medical Board of California found specifically that there was no basis to criticize any of the cardiologist’s clinical judgments or the manner in which he performed any procedures at issue in the case. These significant facts were also supported by several medical experts. After a full trial, the Medical Board of California ruled in favor of the cardiologist in all respects, with the exception of a public letter of reprimand, the lowest form of discipline, pertaining to a minor matter having nothing to do with the quality of care provided to any patient.
