Fenton Jurkowitz Law Group’s Writ of Mandate Petition Granted by Los Angeles Superior Court

Henry Fenton and Dennis Lee successfully litigated a Petition for Writ of Mandate, which was granted by the Los Angeles Superior Court on April 28, 2016, ordering the California Medical Board to dismiss an accusation and withdraw a reprimand against a prominent interventional cardiologist. In an administrative hearing last year, Henry Fenton successfully defended the cardiologist against claims, filed by the California Medical Board, of unprofessional conduct, gross negligence and repeated acts of negligence involving several patients. The only discipline that remained from that case was the reprimand for a matter having nothing to do with the quality of care provided to any patient. The Medical Board issued the reprimand contending that the cardiologist had violated the standard of care by performing peripheral angiography at a hospital not authorized to perform such procedures. In its recent order granting judgment to the cardiologist, the Superior Court ordered the issuance of a writ of mandate dismissing the accusation and setting aside the reprimand.
