Henry Fenton and Nick Jurkowitz successfully represented a physician charged with aiding and abetting a business manager and nurse in the unlicensed practice of medicine.
The case involved a lengthy investigation that uncovered surveillance the Medical Board turned over to the District Attorney’s office for criminal prosecution. Initially, the Medical Board sought to restrict the physician’s license as a condition of bail until the criminal case concluded. We defeated that attempt and were also successful in allowing the physician to continue to practice while the criminal proceedings were taking place. Eventually, the unlicensed manager and the nurse, represented by other attorneys, pleaded guilty to the charge of unlicensed practice of medicine.
The District Attorney eventually agreed to dismiss the charges against our physician client after we prudently filed appropriate legal arguments showing that we would win a case at trial.
